    These Terms and Conditions ("Terms") govern access to and use of the website located at theobscure.com (the "Site"), the purchase of spirits and merchandise through the Site, enrollment in The Obscure's membership program, attendance at The Obscure's in-person guided tasting experiences, and service at The Rising Sun café and bar ("TRS") (collectively, the "Services"). The Services are owned and operated by Ad Obscura, LLC ("Ad Obscura," "The Obscure," "we," "us," or "our"), located at 1356 Palmetto St., Los Angeles, CA 90013.

    By accessing the Site, placing an order, purchasing a ticket, or enrolling in the membership program, you ("you" or "Guest") agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

    1. Age Requirement

    The Services involve information about, marketing of, and sale of alcoholic beverages, and admission to a venue where alcohol is served. You must be at least 21 years of age to access the Site, place an order, purchase a ticket, or enter any of our venues. By using the Services, you represent and warrant that you are at least 21 years old. We reserve the right to require valid government-issued photo identification at any point, including at delivery and at venue check-in, and to refuse service, delivery, or entry to anyone who cannot provide it.

    2. Purchases of Alcohol Products

    • All spirits sold through the Site are currently offered for sale and shipment to addresses within the State of California only, and only to individuals 21 years of age or older.

    • Deliveries of alcohol require an adult signature (21+) at the time of delivery. We are not responsible for orders that cannot be completed because no eligible adult was available to sign.

    • We reserve the right to refuse, cancel, limit quantities on, or delay any order at our discretion, including where we suspect a violation of these Terms or applicable law, or where a product is out of stock or mispriced.

    • You agree not to resell, or purchase for the purpose of resale, any product purchased through the Site without our prior written consent and any licenses required by law.

    • Please enjoy our products responsibly. Do not operate a vehicle or machinery after consuming alcohol.

    3. Pricing, Payment, and Shipping

    Prices are listed in U.S. dollars and are subject to change without notice. We use commercially reasonable efforts to display accurate pricing and product information, but errors may occur; in the event of a pricing or listing error, we may cancel the affected order and will refund any amount charged. Applicable sales tax and shipping fees will be added at checkout where applicable. Orders are processed and shipped only to eligible addresses within California, subject to carrier and legal requirements for alcohol shipments. Estimated delivery times are not guaranteed.

    4. Returns and Refunds

    Because our products are consumable alcoholic beverages, all sales are generally final. If an item arrives damaged, defective, or incorrect, contact us within 7 days of delivery and we will work with you in good faith to arrange a replacement, store credit, or refund at our discretion.

    5. Ticketed Experiences and Venue Visits

    • Tickets to The Obscure's guided tasting experiences are currently sold through our third-party ticketing partner, Fever. Ticket purchases, cancellations, rescheduling, and refunds for the ticketed experience are subject to Fever's own terms of sale and refund policies, in addition to the venue policies described here.

    • Entry requires a valid ticket confirmation and valid government-issued photo ID confirming you are 21 years of age or older. We may refuse entry to any guest who cannot provide both, without refund, except as required by Fever's policies.

    • We recommend arriving approximately 15 minutes before your scheduled time. Late arrival may result in a shortened experience or denied entry at our discretion.

    • We reserve the right to refuse service or remove any guest who appears visibly intoxicated, disorderly, or who otherwise poses a risk to themselves, other guests, or staff, without refund.

    • The experience takes place in a venue with theatrical lighting, live performers, candles, fog/haze effects, and close seating. By attending, you assume the ordinary risks associated with attending a live, immersive event in these conditions, and with consuming alcohol.

    • We will make reasonable accommodations for guests with disabilities, including accommodations for deaf, hard-of-hearing, and low-vision guests, where requested in advance. Contact us ahead of your visit to arrange accommodations.

    5.1 The Rising Sun (TRS)

    TRS is a walk-in café and bar operated by Ad Obscura, LLC. Unlike the guided tasting experience described above, TRS does not require a ticket purchased through Fever, and the Fever-specific bullets in this Section 5 — ticket confirmation, Fever's cancellation and refund policies, and the 15-minute arrival guidance — govern the guided tasting experience only and do not apply to TRS.

    6. Membership Program

    • The Obscure offers an optional, tiered paid membership program that may include event access, discounts, complimentary tickets, and other perks as described on the Site at the time of enrollment.

    • Certain memberships begin with a complimentary trial period (for example, a bottle purchase may include a complimentary 12-month Level 1 membership). During a trial period, we keep your payment method on file but do not charge it. If you do not cancel before the trial period ends, your payment method will be charged automatically at the then-current price for your membership tier, and your membership will continue on a recurring basis as described below. The length of any trial, the price that will apply once it ends, and the deadline to cancel before being charged will be disclosed to you at the time of enrollment.

    • Membership — including any membership that has converted from a trial period — is billed on a recurring basis (for example, monthly) to the payment method on file until cancelled. You authorize us to charge that payment method automatically each billing cycle, including the first charge following the end of any trial period.

    • You may cancel your membership, including during a trial period, at any time through your member account or by contacting us. Cancelling during a trial period will prevent any charge from occurring. Cancelling after a trial has converted to a paid membership will take effect at the end of the then-current billing cycle, and we do not provide prorated refunds for partial periods unless required by law.

    • Membership perks, tiers, pricing, and benefits are subject to change with reasonable notice, and are subject to availability (for example, complimentary tickets and event access may be limited by capacity).

    • Your Everlocker assignment (personal bottle storage), where applicable, is non-transferable and remains our property. Other membership perks that the Site expressly designates as shareable or giftable (for example, a season pass gifted to a guest) may be used as described on the Site. Except as expressly permitted, membership accounts and their benefits may not otherwise be sold, transferred, or shared.

    7. Accounts

    Certain features, including membership and order history, require creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

    8. Acceptable Use

    You agree not to: use the Site or venue for any unlawful purpose; misrepresent your age or identity; attempt to circumvent age-verification measures; interfere with or disrupt the Site, our systems, or the experience of other guests; scrape, reverse-engineer, or resell access to the Services without authorization; or use the Services in any way that infringes the rights of Ad Obscura or third parties.

    9. Intellectual Property

    All content on the Site — including text, graphics, logos, product names, recipes, photography, video, and the overall look and feel of the experience — is owned by or licensed to Ad Obscura, LLC and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written permission, except for personal, non-commercial use in connection with your visit or purchase.

    10. Third-Party Services and Links

    The Site and Services may reference or link to third-party services, including our ticketing partner (Fever), payment processors, social media platforms, and retail partners who carry our bottles. We do not control and are not responsible for the content, policies, or practices of third-party services. Your use of those services is subject to their own terms.

    11. Disclaimers

    The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

    12. Limitation of Liability

    To the fullest extent permitted by law, Ad Obscura, LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or relating to your use of the Services. Our total aggregate liability for any claim arising out of these Terms or the Services will not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

    13. Indemnification

    You agree to indemnify and hold harmless Ad Obscura, LLC and its owners, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any applicable law, including alcohol laws.

    14. Governing Law and Disputes

    These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

    15. Changes to These Terms

    We may update these Terms from time to time. The "Effective Date" above will reflect the date of the most recent revision. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Material changes affecting active members will be communicated by reasonable means, such as email or a notice on the Site.
